CONSTITUTION AND BY-LAWS

ARTICLE 1
Organization
 
Section 1: This organization shall be known as the International Association of Firefighters, Local 3390 – Gig Harbor Professional Firefighters Pierce County Fire District No. 5.
 
Section 2: References in this Constitution and By-laws to the Local shall refer to IAFF Local 3390 as set forth in section 1 above.
 
Section 3: This Local, its officers, representatives and members shall recognize, observe and be bound by the provisions of the Constitution and Bylaws and the interpretations rendered by the Local President, the resolutions, decisions and directives of the Executive Board of the Local when made in conformity with the authority granted by the Constitution and By-laws of the Local.
 
ARTICLE 2
Jurisdiction
 
Section 1: Jurisdiction shall be as follows - Gig Harbor Professional Firefighters (GHPFF) Bargaining Unit: All full-time and regular part-time uniformed firefighters; excluding non-uniform, supervisory and confidential employees. Gig Harbor Fire & Medic One (GHF&MO) Civilian Bargaining Unit: All full-time and regular part-time employees in the following classifications: Lead Mechanic, Fleet Mechanic, and Facilities Maintenance Technician.
 
ARTICLE 3
Membership
 
Section 1: Active: Any person of good moral character who at the time of making application, is engaged in service within the jurisdiction of the Local, as defined in Article 2, will be eligible for active membership. Anyone eligible for membership in the Local shall not be refused membership or, upon acceptance, be discriminated against because of race, color, sex, religion, or national origin.
 
Section 2: Honorary: For meritorious service to this Local or for distinguished public service, persons may be elected honorary members by a majority vote. Honorary members shall not pay initiation fees, dues, or other charges and shall have no voice or vote in the Local. Such membership may be revoked for cause.
 
Section 3: Maintenance of Good Standing: Membership in good standing includes any person who has fulfilled the requirements for membership in the Local and who has not voluntarily withdrawn, become ineligible for continued membership, or been suspended or expelled as provided by the Constitution and By-laws.
 
Section 4: Separation: When any member in good standing becomes separated from the Fire District, the Local may allow said member to retain his/her active membership until such time that it is determined that the member will not return to employment by the District.
 
Section 5: Delinquent Members: Members who fail to pay their monthly dues assessment by the fifteenth day following the month such dues are payable, shall be notified in writing by the Officer whose duty it is, that they are delinquent and will lose their good standing if payment is not received within sixty (60) days following such notification. Delinquent members shall not have a voice or vote in Local affairs.
 
ARTICLE 4
Meetings
 
Section 1: Regular meetings of the GHPFF Bargaining Unit Local shall be held on the second Wednesday of the month at 1900 hours. Executive Board meetings of the GHPFF Bargaining Unit Local shall be held on the second Wednesday of the month at 1800 hours. Meetings shall be held at Station 5-1.
 
Bargaining Units that have not identified an established meeting date or time shall meet as needed with the proper notice to all members.
 
Section 2: Special meetings may be called by a majority vote of the Executive Board. All members in good standing shall be notified of Special Meetings at least seven (7) days prior to such a meeting. The notice shall state the business to be considered at such meetings, and no other business than that stated shall be in order at such meetings.
 
Section 3: Quorum: The quorum for any meeting of the Local, either regular or special meetings, shall be (15%) the number of members in good standing.
 
Section 4: Rights of Members: Every member in good standing shall have the right to attend any meeting and to participate in such meetings in accordance with the recognized rules for procedure as set forth by the Local. Members shall conduct themselves in such a manner as not to interfere with legal or contractual obligations of the Local.
 
Section 5: Rules for Meetings: The rules contained in “Robert’s Rules for Meetings” shall govern the meetings of this Local in all cases not in conflict with this Constitution and By-laws, or interpretations of such.
 
 
Article 5 -
Officers and Elections
 
Section 1: Executive Board: The Principle Officers of this Local shall consist of a President, Vice President, Secretary and Treasurer. These Officers and a Shift Steward from each shift shall constitute the Executive Board.
 
The President shall also be the representative for the GHF&MO Civilians Bargaining Unit.
 
The same person may hold the positions of Secretary and Treasurer.
 
Section 3: Term of Office:
 
The election of the Principle Local Officers will be as follows: The term of the office will be for two years beginning on the first day of May and ending on the last day of April. Two members will be elected each year. President and Treasurer will be elected in odd years. Vice President and Secretary will be elected in even years.
 
The election of the Shift Steward Local Officers will be as follows: The term of the office will be for two years beginning on the first day of May and ending on the last day of April. Two members will be elected each year. A-shift Steward and C-shift Steward will be elected in odd years; B-shift Steward and D-shift Steward will be elected in even years.
 
Section 4: Call for nominations: There shall be three calls for nominations prior to any contested election. The first call for nominations for the positions of President, Vice President, Secretary and Treasurer will be made at the beginning of the regular March meeting. The second call for nominations will be made at the close of the regular March meeting. The third and final call for nominations will be made one week following the March meeting by email to all members in good standing. Nominations shall close 15 days preceding the regular April Meeting.
 
Nominations for the position of Shift Steward shall be made via e-mail to the Secretary between the regular March meeting and the regular April meeting consistent with the aforementioned schedule (A & C odd, B & D even).
 
Any member in good standing can make nominations. Self nomination is acceptable.
 
Section 7: Elections: Ten days prior to the election, a ballot listing all nominations shall be distributed to all members in good standing by the elections committee. Elections shall be by secret ballot.
 
Write in votes are not permitted.
 
Absentee voting shall be performed, provided that the ballot is delivered, signed and sealed to the Secretary at/or before the beginning of the regular April meeting.
 
For the purpose of Shift Steward elections, only members in good standing assigned to the shift in question on/ or before the regular March meeting of said year will be permitted to vote.
 
Votes will be collected and tallied at the beginning of the April meeting.
 
If there is only one candidate for a given office, such candidate shall be declared the winner.
 
If no candidate receives a majority of the ballots cast, there shall be a run-off election between the two candidates who received the most votes.
 
The successful candidate will take office on the first of May and will officiate at the regular May meeting.
 
Section 10: Safety Committee: The Local shall elect two (2) Representatives to the District Safety Committee. Safety Committee Representatives will be elected for a two (2) year term. One Representative (Position 1) will be voted on in the odd years and one Representative (Position 2) will be voted on in odd years. Election and nomination shall follow the same procedure as the other positions of the Executive Board.
 
Section 11: The delegate to the International Association of Firefighters Convention will be the President of the Local. The alternate will be the Vice President of the Local. If either the President or the Vice President of the Local is unable to attend, the Secretary or Treasurer will be the alternate.
 
When the membership of the Local is 101 to 250 members, the delegates will be the President and Vice President of the Local. The Secretary or the Treasurer will be the alternate. If either the President or the Vice President of the Local is unable to attend the convention, the Secretary or the Treasurer shall become a delegate and another Executive Board member shall be selected to become the alternate by a majority vote of the Executive Board.
 
If none of the Principle Officers of the Executive Board are able to attend the convention, any member of the Executive Board may be selected to attend in their place by a majority vote of the Executive Board.
 
ARTICLE 6
Initiation Fees, Dues and Assessment
 
Section 1: Dues shall be paid each month in an amount equal to 1.147% of top step firefighters base salary plus IAFF and WSCFF per capita.
 
Section 2: Assessments may be made only in the following manner: Each member in good standing shall be notified at least thirty (30) days in advance of the date on which that vote for an assessment is to occur. Ratification of the proposed assessment shall become effective upon a 2/3 majority vote of all members in good standing. The vote shall be by secret ballot. Absentee voting shall be permitted, provided the ballot is delivered signed and sealed to the Secretary at or before the beginning of the regular or special meeting.
 
Section 3: Initiation Fee: Initiation fees shall be paid in the amount of $200.00 by all new members. Fees are to be paid in full within six (6) months of the date of hire or the date of joining.
 
Section 4: Members leaving the Local in good standing, for any reason, will be issued a certificate of membership which will allow the member to rejoin at a future time without obligation to pay the current initiation fees.
             
Section 54: Ratification of the contract between Pierce County Fire District No. 5 and all Bargaining Units of Local 3390, increases in the initiation fees, reinstatement fees and/or dues shall require notice of such proposed change to be given to all members in good standing at least thirty (30) days in advance of the date on which the vote of such change is to occur. Ratification of the proposed change shall become effective upon a 2/3 majority vote of all members in good standing. The vote shall be by secret ballot, either paper balloting or electronic balloting will be used for the entire vote.
 
ARTICLE 7
Revenue and Funds
 
Section 1: Audits: The books and accounts of this Local shall be audited annually, and the last such report shall be forwarded each year to the Treasurer over the seal of the Local within sixty (60) ninety (90) days of the close of the Local’s fiscal year.
 
Section 2; Trustees: The Local shall elect two (2) Trustees to help the Treasurer maintain the Locals financial records. These positions shall be two-year (2) terms. One Trustee will be voted on in the even years and one Trustee will be voted on in odd years. The duties of the Trustees shall be to check the books of the Local at least once each year and perform an audit to be presented to the body within sixty (60) ninety (90) days of the close of the Locals fiscal year and at such other times, as they deem advisable. The Trustees shall have full access to all books and records of the Treasurer pertaining to the financial matters of the Local.
 
The Trustee positions shall be elected in accordance with Article 5: Officers and Elections.
 
 
 
 
 
 
ARTICLE 8
Amendments
 
Section 1: This constitution and By-laws may be amended by a 2/3 vote, with the exception of dues, assessments and initiation fees as provided in Article 6, at a regular meeting, provided that each member in good standing is notified at least fifteen (15) days in advance of the meeting at which the vote will be taken.
 
Section 2: A proposed amendment to the Constitution and By-laws, made under its provisions, shall be submitted to the President prior to membership notification, if not proposed in a regular or special meeting.
